A residential real estate closing (also called “settlement”) is the final step in a home purchase transaction where the legal ownership of the property transfers from the seller to the buyer. At closing, all remaining documents are signed, funds are transferred, and the deed is recorded and funds are transferred.
Below is a detailed breakdown of what happens and what it involves.
Purpose of the Closing
The closing exists to finalize the real estate transaction legally and financially, ensuring every detail of the agreement is honored.
Clear Ownership
The closing establishes a definitive legal bridge by officially recording the deed in the buyer’s name, ensuring undisputed rights to the property moving forward.
Fund Transfer
The closing serves as the formal mechanism for the secure exchange of equity and purchase prices, ensuring the seller is paid and all transaction fees are settled.
Public Record
By filing the necessary documents with local government authorities, the closing creates a transparent and permanent history of the transaction to protect future interests.
Lender Security
For buyers using financing, the closing process perfects the lender’s lien against the property, providing the legal collateral required to finalize the mortgage.

Safe Harbor Title Company
Our job is to coordinate documents, funds, and perform all other duties as outlined in the Purchase and Sale Agreement. We will also conduct a title search, issue a title insurance commitment and policy(ies) and cause all recordable documents to be properly recorded in the land records.
The Buyer
Provides the funds and signs mortgage documents and takes legal possession.
The Lender
Provides financing and requires title insurance to protect their investment interest.
The Seller
Transfers ownership and ensures the property is delivered as agreed upon.
Real Estate Agents
Facilitate the communication between all parties to ensure a smooth transition.
The Closing Disclosure
The Closing Disclosure (CD) is a legally required document that provides the final, detailed breakdown of the financial terms of a mortgage loan and the real estate transaction. Its main purpose is to ensure the borrower clearly understands the actual costs and terms of the loan before the transaction is finalized at a residential real estate closing.
It includes:
- Purchase price
- Loan amount
- Interest rate
- Monthly payment
- Closing costs
- Property taxes
- Insurance
- Cash required to close
If a mortgage loan is being made, the Borrowers/Buyers must receive this at least 3 business days before closing.

On Closing Day, Buyers and Sellers (separately) will meet with a representative from Safe Harbor Title to complete the final legal and financial steps to transfer ownership of a property. By the end of the appointment, all documents are signed, funds are finalized, and the property is ready to be officially transferred once the documents are recorded. Closing typically lasts 30 – 90 minutes.
Documents Signed at Closing
For the Buyer/Borrower
If the buyer is using a mortgage, this is the largest part of the appointment. The buyer signs multiple documents that establish the loan.
Promissory Note
The buyer’s legal promise to repay the loan
Deed of Trust (or mortgage in some states)
Creates the lender’s lien against the property as security for the loan.
Closing Disclosure
Confirms the final loan terms and closing costs.
Additional documents may include:
- Occupancy affidavit
- Escrow account disclosures
- Tax forms
- Loan servicing disclosures
The buyer usually signs dozens of documents, though many are informational acknowledgments.
For the Seller
Since the seller is transferring title, this is the most essential part of the appointment. The seller signs multiple documents that legally convey ownership.
Deed
Transfers legal title from the seller to the buyer.
Affidavits and Certifications
These may confirm:
- The seller has not taken additional loans on the property
- No new liens exist
- Property condition disclosures are accurate
The seller also signs documents authorizing the payoff of their existing mortgage.
